As part of our approach to comprehensive services, we custom craft our support solutions based on the chapter 11 case type and company situation in order to provide maximum resources for cost efficiency and effectiveness on each issue. 

  • We appreciate that prearranged cases, a hybrid between prepackaged and traditional chapter 11 cases, prepare solicitation pre-petition but actually execute post petition. 
  • We know that a prearranged case will proceed post petition as an accelerated traditional chapter 11 and triggers the need for post petition case compliance issues, such as schedules and statements preparation and claims processing and objection but on a fast timeframe. 
  • We appreciate that attorneys and advisors will concentrate efforts and resources on simultaneous first day pleading preparation and plan solicitation, but must also prepare for all post petition traditional issues. 

With a prearranged chapter 11 case, we will provide administrative professionals who will simultaneously support case preparation and pre-petition solicitation.  We will also proactively prepare for all immediate post petition bankruptcy code and court ordered compliance activities such as schedules and statements, the 341 meeting, claims and suggestion of bankruptcy.

Prearranged Chapter 11 Case Professional Activities 

For instance, we appreciate that in a prearranged chapter 11 case during:

Pre-petition:

  • Attorneys and advisors will focus on simultaneous preparation for chapter 11 pleadings, immediate post petition solicitation preparation, stabilization of company operations and debt compliance.

Post Petition:

  • Attorneys and advisors will focus on a rapid pace restructuring, seeking to solicit and confirm the plan of reorganization within months of the chapter 11 filing.  They will simultaneously focus on the restructuring of business and financial operations through the bankruptcy code and bankruptcy court orders, working with the company on chapter 11 compliance, and moving the company through the various case processes towards plan solicitation and confirmation.
  • Phase Eleven administrative resources and service teams will concentrate efforts on supporting: immediate post petition solicitation  approval, distribution and intake reporting and tabulation; case administration compliance and dates--i.e. case management orders and critical dates; schedules and statements preparation and filing; claims processing and resolution; claims processing and resolution; data organization and reference--i.e. document production; due diligence support--asset disposition; business operation restructuring efforts--i.e. asset sales and contract rejection; noticing; all additional company restructuring efforts which require administrative assistance.

Post Confirmation:

  • Attorneys and advisors will focus on responding to smaller estate trust administrator and creditors committee issues than in a traditional chapter 11 case.  Estate professional issues relate to objection to claims, recovery of funds and unwinding of remaining estate assets to maximize remaining recovery to estate creditors through a combination of business operations, case administration, claims objection, disbursement and estate litigation.
  • Phase Eleven administrative resources and service teams will concentrate efforts on supporting the estate administrator in: providing supporting documentation and claims information for classification and claims objection; providing payment reports to the creditors committee for preference payment litigation; initiating and conducting estate claims disbursement reports, class treatment and calculations, processing logistics, creditor inquiry and unclaimed funds tracking; and noticing for all filed pleadings.
